Learning to Recognize Risk: A Case Study

This hands-on and entertaining workshop explored a defective construction claim case study drawn from the presenters’ real life experiences in handling litigation on behalf of design professionals. This mock claim involved design professionals, contractors and others and had a particular focus on legal defense strategies. Questions and input from the audience guided the forum for the exchange of ideas on ethical, litigation, risk management and insurance issues. Presented by John P. O'Malley, Esq. and Jeffrey T. Kubes, Esq, partners in the law firm of Crisham & Kubes, Ltd. and Melissa Roberts, Vice President of Euclid Insurance Agencies.

Joseph H. Jones, Esq., AIA and Melissa Roberts, a vice president at Euclid Insurance Agencies, presentation covered contract clauses that are frequently problematic for design professionals and also included negotiation techniques. Topics included code compliance, compensation, construction phase services, document control, opinions of cost and time constraints, among other contract provisions.
Joe Jones is a risk management attorney and director of Schinnerer's risk management services. He provides risk management advice to CNA/Schinnerer insureds, serves as editor of Schinnerer's Proceedings of the Annual Meeting of Invited Attorneys, and is a resource on evolving areas of professional liability exposures for design professionals. As a registered architect, Joe practiced architecture for over ten years, working on projects throughout the United States, Canada, Asia, Europe, North Africa, and the Caribbean.

AIA 2007 Contract Documents and Legal Risk Management Insurance Update
We viewed CNA's previously aired 2007 AIA Contract Documents Webinar followed by a one-hour Q&A and 2007 legal, insurance and risk management update with Laurie Randolph, a partner with the law firm of Hinshaw & Culbertson, and representatives from our office.
This was an excellent opportunity to learn about the changes in the AIA's 2007 Contract Documents from experts who have been involved in the AIA drafting process, who have worked closely with the AIA's Documents Committee, and who have seen the development of these documents over the last 30+ years. This was followed by an update on legal, risk management and insurance topics of interest from 2007 -- including new legislation concerning payment of fees. |
